Like other personal injury claims, premises liability claims require the plaintiff to prove that the defendant was negligent in some way. In the context of premises liability, this means proving that the property owner failed to maintain the property, failed to inspect the property, or failed to take reasonable steps to address a dangerous condition on the property.

In order to have a viable premises liability claim, you must be able to prove the following:

The defendant owned, occupied, or controlled the property
The defendant was negligent in maintaining the property, inspecting the property, or addressing a dangerous condition on the property
You were lawfully on the property (i.e. you were not trespassing)
You suffered injuries/damages

In some cases, the property owner’s negligence is not the only relevant factor. For example, if you were injured on someone else’s property and you were partially at fault, you may still be able to file a premises liability claim. This is because Florida adheres to a pure comparative negligence rule. Under this rule, you can still recover compensation even if you were up to 99 percent at fault for your injuries. However, your total recoverable damages will be reduced by your own percentage of fault.

What Are Common Premises Liability Claims?

There are many different types of premises liability claims, ranging from slip and fall accidents to injuries caused by negligent security. In general, any time a property owner’s negligence leads to a hazardous condition that causes an injury, a premises liability claim can be filed.

What is the Premises Liability Claim Process?

Following an accident on someone else’s property, you may be unsure of what to do next. If you were injured due to the property owner’s negligence, you may be able to file a premises liability claim. However, you will need to take the appropriate steps to protect your rights.

Here is what you need to do if you are injured on someone else’s property:

Get medical treatment. Your health and safety should be your top priority. Even if you do not think you were seriously injured, you should still seek medical treatment as soon as possible. Some injuries, such as traumatic brain injuries and internal injuries, have delayed symptoms. A doctor can evaluate your condition and help you identify any injuries that may have been overlooked. Additionally, seeking medical treatment will create an official record of your injuries, which may be useful if you decide to file a claim.
Report the accident. If you were injured at a business, you should report the accident to the manager or property owner. They may ask you to fill out an incident report. If they do, be sure to ask for a copy. If you were injured at someone’s home, you should report the accident to the homeowner.
Document the scene. If you are able to safely do so, you should take photos of the scene of the accident. Be sure to capture any hazards or dangerous conditions that may have contributed to the accident. If there were any witnesses to the accident, you should get their contact information as well.
Do not give a statement. After the accident, you can expect to be contacted by the property owner’s insurance company. They may ask you to give a recorded statement. However, it is important to know that you are not legally required to do so. In fact, giving a statement can be risky. The insurance company may try to use your own words against you to reduce or deny your claim. We recommend politely declining to give a statement and referring the insurance company to your attorney.
